Privacy Policy for iLabel (Mobile & Web)

Sainmarks Industries (India) Private Limited (“Sainmarks”, “we”, “us”, or “our”) is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our iLabel platform, which is available as a mobile application and a web portal.

This policy is compliant with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Google Play User Data policies.

This policy applies to two distinct user groups:

  1. Sainmarks Sales Team: Internal employees using the app for field operations.
  2. Customers: Clients using the app/web portal for ordering and costing.

1. Information We Collect

We collect information based on your user role and how you interact with the platform.

A. Information Collected from Sales Team Members

If you are an authorized Sales Executive using the mobile app for field work:

  • Location Data (Session-Based):
    • Foreground Location: We collect precise location to check in/out of customer sites.
    • Background Location: We collect location data even when the App is closed or not in use, but ONLY while a tracking session is active.
      • Tracking begins strictly when you tap the “Start Tracking” button.
      • Tracking ends immediately when you tap the “Stop Tracking” button.
      • This data is used for tracking daily sales routes, calculating travel distance, and verifying customer site visits.
  • Device Information: Device ID, battery status, and network status to ensure app reliability during field visits.
  • Visit Evidence: Photos of shopfronts or meetings uploaded during check-ins.
B. Information Collected from Customers

If you are a Customer using the iLabel mobile app or web portal:

  • Business & Contact Details: Company name, contact person, email, phone number, and shipping/billing addresses.
  • Order & Sample Data:
    • Costing Requests: Details regarding garment specifications, fabric types, and label requirements used to generate price quotes.
    • Sample Requests: Artwork files, design mockups (images/PDFs), and physical specifications for prototype creation.
    • Order History: Records of past orders, invoices, and dispatch status.
  • Note: We do NOT collect background location data from Customer accounts.
C. General Usage Data (All Users)
  • Login Credentials: Username and encrypted passwords for authentication.
  • App Performance: Crash logs and performance metrics to improve the platform stability.

2. How We Use Your Information

We use the collected information for the following business purposes:

For Sales Operations (Internal):
  1. Route Monitoring: To track the live location of sales executives during active working sessions.
  2. Attendance & Performance: To verify physical presence at customer locations and mark attendance.
  3. Travel Reimbursement: To calculate distance travelled for fuel/travel allowance based on GPS logs recorded between “Start” and “Stop” tracking.
For Customer Operations:
  1. Costing & Quotes: To calculate and provide accurate pricing estimates based on the specifications you submit.
  2. Sample Development: To process your design files and manufacture physical samples for approval.
  3. Order Fulfillment: To manufacture, package, and deliver your label orders.
  4. Order Tracking: To provide real-time status updates on your production and shipment.

3. Disclosure on Background Location Access (Sales Team Only)

Prominent Disclosure for Sales Executives: The iLabel App collects location data to enable Sales Route Tracking and Customer Visit Verification even when the app is closed or not in use.

IMPORTANT: This collection occurs ONLY when you have explicitly activated the “Start Tracking” mode. You are in control of when tracking begins and ends.

This feature is specific to Employee Accounts. This data is uploaded to Sainmarks’ secure servers to manage field operations in Tiruppur and surrounding regions. We do not use this data for advertising.

4. Data Sharing and Disclosure

We do not share your personal information with outside parties, except in the following limited circumstances:

  • Internal Processing: Customer order data is shared with our factory production and design teams to fulfill requests.
  • Logistics Partners: Customer shipping details are shared with courier/transport services to deliver orders.
  • Service Providers: We use secure third-party cloud hosting services (e.g., Firebase, AWS) to store data.
  • Legal Requirements: If required by law or in response to valid requests by public authorities.

5. Data Retention Policy

We retain your data only as long as necessary to fulfill the business purposes outlined in this policy or as required by law.

  • Transaction, Order & Design Records (Indefinite):
    • We retain all customer order details, invoices, costing sheets, design files, artwork, and mockups indefinitely.
    • Reason: This data is required for future re-orders, design reference, regulatory compliance (Indian Tax Laws/GST Act), and business audit purposes. These records cannot be deleted even upon account closure as they constitute business intellectual property and historical transaction data.
  • Sales Location Data:
    • Route history and check-in logs are retained for 24 months to analyze sales performance and annual route optimization, or for the duration of the employment contract, whichever is applicable.
    • After this period, location data is either anonymized for statistical analysis or permanently deleted.
  • Account Information:
    • Retained as long as your account is active. If you request account deletion, your profile data is removed, excluding the Transaction and Design Records mentioned above.

6. Security & Data Storage

We use industry-standard security measures to protect your personal and proprietary business information (such as design files and costing data).

  • Data Storage Location: Your personal data and business files are stored on secure cloud servers located in India.
  • Data Sovereignty: We ensure that your sensitive personal data primarily resides within the legal jurisdiction of India, in compliance with the DPDPA.
  • Security Measures: We employ encryption in transit (HTTPS) and at rest to safeguard your information. However, please be aware that no electronic transmission is entirely secure, and we cannot guarantee absolute security.

7. App Permissions

The iLabel App may request the following permissions depending on your role:

  • Location (Fine/Coarse/Background): Required for Sales Team only (during active sessions).
  • Storage/Media: Required for Customers to upload design files/artwork and for Sales Team to upload site photos.
  • Camera: For capturing photos of samples or site visits.
  • Notifications: To send order status updates (Customers) or visit reminders (Sales Team).

8. Children’s Privacy (Strict Exclusion)

Our App is not intended for children under 18 years of age. We do not knowingly collect personal data from children under 18.

  • Restriction: No one under age 18 may provide any personal data to or on the App.
  • Action: If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will immediately delete that information.
  • Reporting: If you believe we might have any information from or about a child under 18, please contact our Grievance Officer immediately.

9. Your Rights (Data Principal Rights under DPDPA)

Under the Digital Personal Data Protection Act, 2023 (DPDPA) and Google Play policy, you have specific rights regarding your personal data:

  • Right to Information: You may request a summary of your personal data being processed by us and the identities of any other Data Fiduciaries with whom we have shared your data.
  • Right to Correction: You may request the correction of inaccurate or misleading personal data, completion of incomplete data, and updating of your data.
  • Right to Erasure (Account Deletion): You may request the erasure of your personal data when it is no longer necessary for the purpose for which it was collected, or if you withdraw your consent.
    • Note: We may deny erasure if retention is necessary for compliance with a legal obligation (e.g., Tax Laws).
  • Right to Nomination: You have the right to nominate an individual who shall exercise your rights in the event of your death or incapacity.
  • Right to Grievance Redressal: You have the right to have your grievances regarding our data handling or this policy redressed by our Grievance Officer.
  • Withdrawal of Consent: You may withdraw your consent for data processing at any time. However, this may limit your ability to use certain features of the App (e.g., Sales Tracking).

How to Exercise: To exercise any of these rights, please contact our Grievance Officer listed in Section 10.
